What is a Trademark?
A Trademark is a term, word , picture or logo that connects a brand and a logo to a business. Trademark provides a distinctive identity and reputation to a business. A trademark is necessary to protect the legal rights of the owner of such trademark against the entire world.
Use of TM, SM and ® symbols
‘TM’ means Trademark and ‘SM’ means Servicemark. The use of TM and SM signifies that a person is a owner of such product for which the words are used and he has filed a trademark application for such product
Once the registration of the trademark and service mark is complete and a certificate of registration has been issued , ® symbol is used .
The registration process for both trademark and servicemarks is same under Indian Law.
