If a copyright is registered with the copyright office, it gives an exclusive right to the authors for reproduction. It is creating a public record of the ownership for the person holding the copyright. The registration of copyright is governed by Indian Copyright Act, 1957 and Copyright Rules, 2013. By the applicable provisions and rules, a person holding the copyright can take legal action against people who infringes upon their copyright. Copyright protection is rewarding in the form of economic rights which entitles the creators to exercise control over use of their literary and artistic material in various ways such as producing copies, performing in public, broadcasting, use on-line/on the internet, etc. and to avail an appropriate economic incentive.
If a person has been granted the copyright protection, then the person claiming otherwise have to prove his/her ownership u/s 48 of the Copyright Act. )In a circumstance, where a conflict arises after several years with respect to the first creator of the work, the registration done under this Act carries a great importance as there is a clear written of date on the copyright application. It also provides the copyright owner with economic benefits and profits from his work by utilizing it for fulfilling financial requirements and authorizes him to take legal actions against the person infringing the copyright.
