In India, the use of ©symbol is not necessary to claim copyright protection as India is a member of Berne Convention according to which there is no requirement of such symbol to claim copyright protection. Further,Section 63 of Copyright Act, 1957 makes infringement of copyright a criminal offence if it is done knowingly. The minimum punishment for infringement of copyright is imprisonment for six months with the minimum fine of Rs. 50,000/-.
